On April 1, 2016, at about 2:06 AM, City of Dunkirk Police Officers arrested the same Silver Creek man on Felony Drug Charges for the second time in two weeks during a traffic stop on Lake Shore Dr. East in the City of Dunkirk. Dunkirk Police patrol officers stopped a car for a minor traffic violation and immediately recognized the vehicle and the operator, Jesse James Silvagnia, age 20, 36 Burgess St, Silver Creek, from a crack cocaine seizure in a Lake Shore Dr. West parking lot exactly two weeks ago. Silvagnia was evasive and his irrational explanation of his activity heightened officers suspicion that he was again in possession of narcotics. During the investigation and questioning at the scene, one of the officers observed that Silvagnia had a plastic bag concealed in his mouth. When ordered to spit the bag out, the suspect attempted to swallow the bag to prevent officers from recovering it. Officers had to restrain the suspect and forcibly remove the bag from his mouth. The bag was found to contain a large rock of crack cocaine with an estimated street value of around $80.00. Silvagnia was taken to the Dunkirk City Jail and locked up on charges of Criminal Possession of a Controlled Substance 5th Degree, a Class D Felony, Tampering With Physical Evidence, a Class E Felony and Improper or No License Plate Lamp (Traffic Infraction). He is being held without bail pending arraignment in Dunkirk City Court.
