On March 8, 2016, at about 12:20 AM, Dunkirk Police patrol officers spotted a vehicle occupied by several males acting suspiciously in the parking lot of a local business that was closed for the night. An investigation into the presence of the suspects in the lot lead to the seizure of a large rock of crack cocaine, with a street value of around $100.00, a small amount of marijuana and a set of metal knuckles. The metal knuckles are an illegal weapon under the New York State Penal Law. Police also confiscated a large dagger, a realistic looking semi-automatic BB gun, a crack pipe and other assorted drug paraphernalia during the incident. The men are identified as Joshua S. Heimerl, age 19, of Angola NY, Jesse S. Nahrebeski, age 21, of Silver Creek NY and Jesse J. Silvagnia, age 20, also of Silver Creek. Nahrebeski and Silvagnia were each charged with Criminal Possession of a Controlled Substance in the 5th Degree, a felony, and Unlawful Possession of Marijuana, a violation. Heimerl was charged with Criminal Possession of a Controlled Substance 5th Degree, a felony, Unlawful Possession of Marihuana, a violation, and a misdemeanor count of Criminal Possession of a Weapon in the 4th Degree after the metal knuckles were found in his possession. All three were held without bail pending arraignment in Dunkirk City Court.
