On March 23, 2019, at about 1:30 PM, Dunkirk Police officers responded to 152 Lake Shore Dr E, in the City, for a report of a person with a gun. Upon arrival, officers observed a vehicle leaving the scene that witnesses reported the firearm was being taken away from the scene in. Officers performed a traffic stop in the parking lot of the Steger High Rise parking lot which is located at 15 N. Main St, Dunkirk, NY. Simultaneously, officers received reports that the individual alleged to have threatened subjects at the Lake Shore Dr E location with the firearm was running south on S. Beaver St from Lake Shore Dr. That individual was located and apprehended.
Through investigation, officers found the occupants of vehicle to be Christian M. Padilla-Rivera, age 29, Limarys Carmona, age 41, Aixmary R. Rodriguez-Rosa, age 35, all of Dunkirk, NY, and in possession of a loaded defaced pistol. It is alleged that none of the subjects had any legal right to possess the firearm. All subjects were taken into custody and charged with Criminal Possession of a Weapon in the Second Degree (C/Felony) and Manufacture, Transport, Disposition and Defacement of Weapons and Dangerous Instruments and Applicances. Catala was additionally charged with two counts of Menacing in the Second Degree and one count of Criminal Possession of a Weapon in the Third Degree (D/Felony) for previously being convicted for a crime.
